PROPOSITION
“Shall the City of Kimball, Nebraska, amend its Economic Development Program as described here by appropriating annually from local sources of revenue an estimated $400,000 in fiscal years 2010-11 through 2030-2031 or such greater amount up to 0.4% of taxable valuation of the City as may be generated from the sales tax previously approved for such Economic Development Program and from City property taxes, making the present annual cost of such economic development program $40.00 per ten thousand dollars of assessed valuation?”

AGAINST said amendment of the program.
Electors desiring to vote in favor of the proposition shall blacken the oval preceding the words “FOR said amendment of the program”.
Electors desiring to vote against the proposition shall blacken the oval preceding the words “AGAINST said amendment of the program”.
Description of the Economic Development Program Amendment: The Kimball Economic Development Program Amendment approved by the City Council, which would amend the existing Kimball Economic Development Program as approved in a proposition submitted to and approved by the voters of the City at a special election held in the City on September 11, 2007, is as follows:
Activities Eligible for Assistance. Specifically added to the activities eligible for assistance under the Program is indirect assistance to qualifying businesses in the City through one or more grants to the City’s Community Development Agency (the “CDA”) for its use in constructing and acquiring of a railroad spur to be located within an area designated as blighted and substandard by the City (the “Rail Spur”) to serve qualifying businesses within the City by virtue of leasing the Rail Spur on a nonexclusive basis to the qualifying businesses. Such grant or grants shall be funded by bonds issued by the City in an amount not to exceed $3,000,000 payable from the sources of funds identified below.
Source of Funds. The source for Economic Development funds shall be (1) the 1/2% City sales and use tax provided for in a proposition submitted to and approved by the voters at a special election held in the City on September 11, 2007, and (2) an annual real estate tax levy of up to four tenths of one percent (0.4%) of the taxable valuation of the City less other funds appropriated from local tax sources for all economic development programs of the City, such limitation being as provided in Section 18-2717, R.R.S. Neb., 2007.
The total amount to be collected is estimated to be $400,000.00 for each fiscal year in which the tax is in place or such greater amount as may be collected up to the statutory limitation of not to exceed four tenths of one percent of the taxable valuation of the City.
Additional Source of Funds: Additional funds from other non-city sources will be sought beyond those derived from local sources of revenue, including without limitation revenues received from the CDA’s lease of the Rail Spur to Qualifying Businesses and funds from grants.
Duration of the Program. The length of time that the program shall be in existence shall be extended to the 30th day of September, 2031.
Years for Collection of Funds: Collection of funds for the Program (as amended hereby) shall continue to be from a sales tax on all taxable sales, which began on the 1st day of October, 2008 and shall end on the 30th day of September, 2023 (a total of 15 years); and from a levy of real estate taxes on all the taxable property within the City beginning in the fiscal year 2010-2011 and ending at the expiration of the Program on the 30th day of September, 2031, in an amount not to exceed four tenths of one percent (0.4%) of the taxable valuation of the City less other funds appropriated from local tax sources for all other economic development programs of the City.
Revolving Loan Fund Administration. Section VI of the existing Program regarding the purpose and administration of the revolving loan fund under the Program is amended by replacing Subsection B with the following regarding administration of the revolving loan fund:
B.) Program Administration: The revolving loan fund requires specific administration procedures to insure that applications receive an objective underwriting review; remain confidential and outside the political process; and are administered in a way that is consistent with sound banking procedures. The authorizing statute also requires a "Citizens Advisory Committee” to oversee all activities of the "Program".
1. The Director of Economic Development will administer the “Program”.
2. The Mayor shall appoint a minimum of 5 or a maximum of 9 to the "Citizens Advisory Committee". The Mayor shall seek the advice of the Economic Development Director when developing the list of appointments. All appointments are subject to the approval by the City Council. The authorizing statute does not permit elected officials to be voting members of the "Citizens Advisory Committee." Suggested participants for this committee include:
a. Small business owners
b. Those familiar and experienced with the local Economic Development Program
c. Representatives from the hospital, county and/or schools
d. Those that have expertise or experience in the field of business finance or accounting.
e. Those that hold special knowledge or expertise in Economic Development activities
f. Representatives from local financial institutions.
g. Member of the general public
h. All committee members shall be registered voters of the municipality.
3. Appointments or reappointments shall be made during the City of Kimball's annual re-organization meeting prior to the beginning of each calendar year and approved by City Council. Vacancies shall be filled as soon as practical.
4. The Citizens Advisory Committee shall serve as the Loan Committee.
Effect of the Amendment. The original Kimball Economic Development Program shall remain in effect with only such changes or modifications as provided in the Kimball Economic Development Program Amendment as described above.

A vote FOR this amendment will authorize the Legislature to permit counties, cities, and villages to acquire, own, develop, and lease or finance real and personal property for use by nonprofit enterprises for nonsectarian, nondevotional, and nonreligious purposes and to issue revenue bonds for such purpose; will prohibit the use of condemnation for acquiring the county, city, or village to impose any tax to repay the obligations represented by such revenue bonds.
A vote AGAINST this amendment will not authorize the Legislature to permit counties, cities, and villages to acquire, own, develop, and lease or finance real and personal property for use by nonprofit enterprises or to issue revenue bonds for such purpose.
A constitutional amendment to authorize the use of revenue bonds to develop and lease property for use by nonprofit enterprises as determined by law.
